These terms and conditions ("Terms of Use") outline important requirements related to your use of the website printersetupexpert.com and the computer repair and support services provided by printersetupexpert.com. It is essential to read these terms carefully, as they contain significant information and instructions regarding the duration of the agreement, early termination fees, our rights to modify conditions, liability limitations, privacy, and dispute resolution through arbitration rather than court proceedings. Your acceptance of these terms applies to all service plans provided by us, including any existing plans. By using the services offered by printersetupexpert.com, you imply your acceptance of these terms and conditions.

AGREEMENT

These terms and conditions, along with each accepted plan order you submit, any additional terms related to your plan order, the Acceptable Use Policy (AUP), and the Privacy Policy, constitute the complete agreement between you and printersetupexpert.com (the "Agreement"). A plan order becomes part of the "Agreement" only if it has been acknowledged by printersetupexpert.com in writing or via email. You must agree to these terms and conditions to access the printersetupexpert.com portal (defined below) or obtain services (defined below).

DEFINITIONS

Certain terms defined in these Terms and Conditions are also referenced in the Acceptable Use Policy (AUP) and the Privacy Policy.

"Content"

"Content" refers collectively to Software, Materials, Services, and related information.

"You"

"You" refers to you as an individual and any person or entity you represent, including your employer.

"printersetupexpert.com"

The trademark "printersetupexpert.com" is used by Printer Setup Expert under a license. References to printersetupexpert.com denote Printer Setup Expert.

"printersetupexpert.com Certified Technician(s)"

A "printersetupexpert.com Certified Technician" is defined as technicians and specialists who are certified by printersetupexpert.com to perform the Services under this Agreement.

"SHARED SERVICES"

"Shared services" refers to services provided by one part or group within Printer Setup Expert and/or its suppliers to multiple organizations or groups outside Printer Setup Expert.

"Subscription Based Plans"

"Subscription Based Plans" or "Subscriptions" are ongoing subscription plans offered by printersetupexpert.com, active for a specified duration, excluding incident-based plans like “Per Incident Plan.”

"Services" AND "printersetupexpert.com Portal"

References to "Services" encompass any printersetupexpert.com service plan you enter into via the printersetupexpert.com website at www.printersetupexpert.com (the "printersetupexpert.com Portal") or by calling the phone number provided on the printersetupexpert.com website. These Terms of Use govern all plans available through the printersetupexpert.com website and any use of the printersetupexpert.com Portal. In case of a conflict, these Terms of Use take precedence over any valid Plan Order you submit requesting Services.

"Materials"

"Materials" refer to any webcasts, download areas, white papers, press releases, datasheets, FAQs, product information, quick reference guides, or any other types of works available for download from the printersetupexpert.com Portal, which are the proprietary and copyrighted works of printersetupexpert.com and/or its suppliers. The term "Materials" does not include the design or layout of the printersetupexpert.com website or any other printersetupexpert.com owned, operated, licensed, or controlled website.

"Software"

"Software" encompasses any computer program, whether owned by printersetupexpert.com or a third party, delivered via download, CD, or other methods, including client and/or network security software. Software elements are protected under copyright, trade secret, unfair competition, and other laws. Software includes both printersetupexpert.com Software and third-party Software. Your use of the Software is governed by the respective agreements, such as a license agreement or user agreement, that accompany or are included with the Software.

SUBMISSION OF PLAN ORDERS; SERVICE PLANS

You can order Services by submitting Plan Orders through the printersetupexpert.com Portal or by contacting printersetupexpert.com directly. Once your Plan Order is accepted, you will receive an email confirmation at the address you provided during the registration process. printersetupexpert.com is not responsible for providing Services for any Plan Order it has not accepted. Upon acceptance of your Plan Order, you will have a Service Plan.

UNDERTAKING

Subject to these Terms and Conditions and specific terms for each Service Plan, printersetupexpert.com will make commercially reasonable efforts to address your inquiries and provide appropriate solutions under the Services. Typically, printersetupexpert.com will attempt to diagnose issues and offer solutions via chat, email, remote access, or scheduled onsite visits as deemed appropriate. You acknowledge that if remote access is utilized, there will be no residual software from the session, but a text file may be generated to document the work performed. You may choose to save or delete this file. All undertakings under Service Plans are subject to printersetupexpert.com’s Limited Warranty. For more details, please refer to the online documentation or contact us. You agree to pay all Service Fees and any other applicable charges as outlined in the relevant Plan Order according to the Payment Terms specified below.

PAYMENT

Services related to any Plan Order will be available only after payment has been made according to the requirements of the corresponding Plan Order. printersetupexpert.com has no obligation to provide Services under any Service Plan unless all required payments for the Plan Order have been received.

Certain Service Plans may have fees, including but not limited to "Service Fees" and/or "Activation Fees," payable either annually ("Annual Payment Plan") or monthly ("Recurring Payment Plan"). For the Annual Plan, all payments must be made upfront at the beginning of the subscription cycle. For the Recurring Payment Plan, in addition to the monthly installments of the Service Fee over a one-year term, an additional non-refundable Activation Fee will be charged at registration, as specified in the Plan Order. Fees (including the Activation Fee) are non-refundable in case of Service Plan cancellation unless stated otherwise in the Plan Order. All fees mentioned herein or in the relevant Plan Order are due at the commencement of the Service Plan.

When you purchase a Service, you agree to a specified price and plan, which may last for one, two, or three years ("Term Plan"). All Service Fee terms and any other fees under any payment method for a Subscription will be outlined in the applicable Plan Order. Some plans may offer discounts if you subscribe to additional printersetupexpert.com services ("Bundle Discount"). You agree to maintain your Service and the bundled services for the applicable term. If you subscribe to a Term Plan or Bundle Discount, the special rate remains valid until one of the following occurs: (1) the Term Plan expires; (2) you discontinue one of the required printersetupexpert.com services to retain the discounted rate; or (3) you terminate the agreement/Service Plan before the term ends.

Credit Card Billing: You may need to provide a credit card number from an accepted card issuer to activate your Service. You authorize printersetupexpert.com to charge or place a hold on your credit card for any unpaid charges for Services or related equipment. You authorize the card issuer to pay these amounts without requiring a signed receipt, and you accept these charges as authorization for the card issuer to pay all stated amounts. You agree to provide updated credit card information upon request or when your previous information is no longer valid. Neither printersetupexpert.com nor any affiliated company is liable for non-sufficient funds or other charges incurred as a result of these attempts to charge or hold your credit card. If you mistakenly provide a debit card number instead of a credit card, you authorize charges to be applied to that debit card until you provide a credit card number. If you enroll in an automatic payment or electronic funds transfer plan, all amounts due may be charged to the account number provided for that plan. Payments made by credit or debit card will also be subject to the terms and conditions set by the card issuer. If your credit card cannot be charged or if a bank draft or electronic funds transfer is returned for insufficient funds, payment will proceed through check.

RENEWAL POLICY

You acknowledge that a Subscription under the Recurring Payment Plan will automatically renew each month unless you notify us otherwise at least 30 days before your subscription ends ("Auto Renewal"). However, a Subscription under the Annual Payment Plan does not automatically renew and will expire at the end of the applicable Term Plan.

Your credit card will be charged the current subscription rates according to the payment option you selected when registering with printersetupexpert.com.

To opt out of Auto Renewal, please contact us and speak with a customer service representative at least 30 days before your subscription ends.

REFUND POLICY

For subscription-based plans, a full refund will be provided if printersetupexpert.com has not resolved any issues within the first 30 days of your subscription.

If one or more issues have been resolved, the fees for the Subscription Service are non-refundable. However, printersetupexpert.com may, at its discretion and on a case-by-case basis, agree to a refund of Subscription fees after deducting charges for services rendered.

For incident-based plans, you may be eligible for a refund if any of the following criteria are met:

  • You meet all prerequisites needed to resolve the issue, but the issue remains unresolved while your account is active.
  • The issue is outside the scope of the specific plan.
  • Seven days have not passed since the last work was performed by a printersetupexpert.com technician.
  • ACCEPTABLE USER POLICY (AUP)

You agree to comply with the Acceptable User Policy (AUP) as outlined on the printersetupexpert.com website.

LIMITATIONS ON LIABILITY

IN NO EVENT SHALL printersetupexpert.com OR ANY OF ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR IN CONNECTION WITH THE SERVICES OR THE AGREEMENT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

THE AGGREGATE LIABILITY OF printersetupexpert.com UNDER THIS AGREEMENT SHALL NOT EXCEED THE AMOUNTS PAID BY YOU FOR THE SERVICES IN THE TWELVE MONTHS PRECEDING THE DATE OF THE CLAIM.

GOVERNING LAW; ARBITRATION

This Agreement will be governed by the laws of the State of California without regard to its conflicts of laws provisions. Any dispute arising out of or relating to this Agreement will be settled by binding arbitration conducted in Los Angeles County, California, in accordance with the rules of the American Arbitration Association. The parties waive their right to a jury trial and agree that all disputes will be handled individually and not as a class action.

  • For existing customers, please log in at http://helpdesk.printersetupexpert.com using your registered email to create a new service ticket and monitor its status.

If your system requires part replacement, the cost for the parts will be additional. Our repair team will reach out to you for approval before proceeding.

If the device is brought in with no power, no display, or is completely non-functional, we will conduct a thorough examination and provide an exact diagnosis along with a list of defective parts. We may contact you multiple times for revised approvals on additional parts as needed.

Our repair and workmanship warranty lasts for one month, provided that the equipment has not been tampered with or managed by another vendor after our repair. The warranty on replaced parts is separate and adheres to the manufacturer's guidelines.

In the case of physically damaged equipment or hardware issues, any parts that are intermittently functional may stop working during diagnosis and repair. If you decline further repairs, printersetupexpert.com cannot guarantee the device will return to its previous partially working condition.

Please note that printersetupexpert.com does not guarantee against data loss or full data recovery. Data backup is offered as a separate paid service. However, for small data volumes (under 10GB), we provide backup free of charge. During this free service, we advise against backing up music or video files during operating system reinstallation or any other repair process.

The customer agrees to indemnify printersetupexpert.com for any software or license validity issues regarding their equipment. We do not support or endorse piracy in any form. We recommend keeping original CDs and licenses for all pre-installed application software. printersetupexpert.com is not liable for any loss of installed software during repairs.

“Per node” refers to each specific desktop, laptop, netbook, printer, and devices, with or without an IP address, as defined in the final invoice. The rights for hardware replacement rest solely with printersetupexpert.com to install new or refurbished parts. Warranty for parts is provided by the respective part manufacturers.

We are not liable for any instances of pre-installed pirated software. The start and end dates specified in the invoice outline the customer service period. All hardware repairs will take place in our Technical Repair Centre.

While your equipment is with printersetupexpert.com, we will take all precautions to ensure its safety, but we are not liable for data loss, data theft, or any damage or loss of the equipment during the service period. Please ensure that the request ID or invoice ID is mentioned when collecting your invoice.

General License Restrictions

Any unauthorized use of the printersetupexpert.com Portal, Services, Materials, or Software is prohibited. All rights to execute, copy, modify, display, transmit, distribute, manufacture, use, and sell are reserved for printersetupexpert.com and its suppliers. Reverse engineering or decompiling the Software is strictly forbidden.

User Responsibility

In obtaining our Services, you agree to:

Cooperate with the Technician: Our technicians will make every effort to assist you, and your cooperation is essential. Please listen to their instructions carefully. You confirm that:

The issue can be reproduced on a single system (one CPU with its workstations and peripherals).

You possess knowledge about the hardware, relevant software, and the circumstances surrounding the issue.

The complete system, including software and hardware, is available and accessible during phone discussions with support personnel.

Software/Data Backup: You acknowledge that printersetupexpert.com is not responsible for any loss or corruption of software or data. We strongly recommend maintaining a complete data backup and disaster recovery plan.

Account, Password, and Security: To submit a Plan Order, you must complete the registration process by providing current, complete, and accurate information. You will choose a password and username and are solely responsible for keeping your password and account secure. Notify printersetupexpert.com immediately of any unauthorized account use. You are liable for any actions taken under your account, including those resulting from someone else using it.

Availability of Services and Materials Under Force Majeure Circumstances

You acknowledge that circumstances beyond printersetupexpert.com’s control (e.g., natural disasters, large-scale computer virus outbreaks, strikes, civil disorder, etc.) may cause delays in support scheduling. You release printersetupexpert.com from liability for any damages resulting from such delays.

printersetupexpert.com or its suppliers may restrict service use or limit availability for maintenance without notice.

Exclusions from “Services”

“Services” exclude:

  • Any item or activity not covered by a Plan Order.
  • Service exceeding the duration limits specified in your Plan Order.
  • Problem diagnosis and support hindered by issues beyond our control.
  • Software and operating systems not covered by the Service Plan.
  • Issues arising from external causes (accidents, misuse, electrical problems, etc.).
  • Non-compliance with technician instructions.
  • Exclusions from “Shared Services”

“Shared Services” do not cover:

  • Any item or activity not included in the Plan Order.
  • Services beyond the limits specified in your Plan Order.
  • Problem diagnosis hindered by issues beyond our control.
  • Software and operating systems not covered by the Service Plan.
  • External causes or non-compliance with technician instructions.
  • Notice Regarding Materials and Software Available on the Printer Setup Expert Portal

For your convenience, we may offer Materials or Software for use or download as part of a Service or promotional activity. Use of these is governed by the stricter of (a) the end-user license agreement (EULA) accompanying specific Materials and Software or (b) these Terms and Conditions if no EULA exists.

You may only download Materials and Software for use per the EULA and your Plan Order. Reproduction or redistribution not in accordance with the EULA is prohibited by law.

No logos, graphics, sounds, or images from printersetupexpert.com may be copied or retransmitted without explicit permission.

End User License Agreements (EULA) – General

As part of our Service, we may provide software owned by printersetupexpert.com or third-party licensors. We reserve the right to update or change the Software, and you agree to cooperate in installing any updates. You may use the Software only as part of the Service per the Service Plan.

The Software may come with an EULA from printersetupexpert.com or a third party. You must agree to the terms before installing any Software with an EULA.

EULA for Printer Setup Expert Software

Regarding any Software provided through our Portal without requiring acceptance of a separate license agreement, you receive a revocable, non-exclusive, non-transferable license to use it according to your Service Plan. You may not copy, disclose, decompile, reverse engineer, or transfer the Software to third parties. All rights to the Software remain with printersetupexpert.com or its third-party licensors.

Third Party Products

As part of our Services, we may recommend certain third-party software or services. You must agree to the respective terms before installation, and printersetupexpert.com is not responsible for or licensed to you for any third-party software.

Your license to printersetupexpert.com Software remains effective unless terminated by us or until your Service Plan ends. Upon termination, you must cease using the Service and delete the Software from your system.

Third Party Agreements

If you choose to use third-party services, your use is subject to that provider's terms. You agree to comply with those terms, and any violation may lead to termination of your account with printersetupexpert.com.

Limited Service Warranty

printersetupexpert.com disclaims all warranties regarding the Services, Materials, and Software. If you are not satisfied with the Services, your sole remedy is to allow us to reperform the disputed Services or to re-download and reinstall the Software.

Some service plans include a 7-day limited warranty, contingent on fulfilling specific terms.

Limitation of Liability

In no event will printersetupexpert.com be liable for damages exceeding what you paid under the applicable Plan Order. If our personnel handle your hardware, printersetupexpert.com will not be liable for any damages incurred during transit or repair.

Limitations on Actions

Any claims must be initiated within three (3) months of the cause of action; otherwise, they will be waived.

Term and Termination

printersetupexpert.com may terminate or suspend your Service without notice if you breach these Terms, your usage is prohibited by law, or printersetupexpert.com receives a court order to terminate the Service. We may also refuse to accept your request for Service after termination.

Severability; Waiver

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in effect. Failure to enforce any provision does not waive our right to do so in the future.

No Offer

The printersetupexpert.com Portal is available in the UK, US, and India, and may reference products and services not available in your location.

Modification

printersetupexpert.com reserves the right to modify these Terms at any time by posting a revised version or by sending notification to your registered email. You are responsible for regularly checking the website for updates. Continued use of the Portal or Services signifies your acceptance of the amended Terms.
